Terms of Service and Conditions

These Terms of Service (“Agreement”) govern the use of the services provided by Scoop and Go Pros LLC (“Company,” “we,” “our,” or “us”), a pooper scooper business based in Colorado. By using our services, you agree to comply with these Terms. Please read them carefully before using our services.

Service Terms

  • By accepting the Service Provider's (Scoop and Go Pros LLC) online fee quote (for individual/residential clients) you agree to an ongoing, recurring service until canceled under these Terms of Service.
  • By accepting emailed custom proposals and estimates (for community/commercial clients) you agree to an ongoing, recurring service until canceled under these Terms of Service.

Customer (Your) Responsibilities

  • As our customer, you are responsible for ensuring safe and accessible entry to your yard. If we are unable to perform a cleanup due to restricted access, the scheduled visit will still be charged.
  • Please make sure your gate is fully functional, and your yard is maintained so waste is visible.
  • Additionally, you must promptly notify our office of any changes in the number of pets and ensure timely payment of balances due.

Scoop and Go Pros LLC Responsibilities

Our primary responsibility is to remove pet waste from your backyard. We clean grassy and common areas unless you specify additional locations your dog uses, such as front yards, raised patios, hidden dog runs, or garden areas. Additional charges may apply if the total cleanup area exceeds 1/2 acre.

Aggressive Pets

  • If your dog is aggressive, please inform us in advance.
  • We will not service yards with aggressive animals present.
  • If an aggressive pet prevents service, you will be charged for the visit.
  • If an employee is bitten, they will immediately seek medical attention, and all medical costs will be your responsibility.

Scoop and Go Pros 100% Guarantee

If you're not satisfied with a cleanup, notify us within 24 hours, and we'll return to reclean your yard within two business days (oftentimes we return that same day).

Billing & Payment

  • You must provide a credit card or ACH or other accepted form of payment method upon service acceptance.
  • Your stored payment method will be charged based on the agreed payment terms.
  • If your payment method fails and is not updated and/or processed within 10 business days after notification, your service may be terminated.
  • If payment has not processed at day 11, a late fee of 2% of any outstanding balance will be assessed on the first day of each month.
  • Payment is due based on the plan selected at the time of service acceptance.
  • If applicable, sales tax will be added based on your location.
  • If payment is overdue, you are responsible for reasonable collection and attorney fees incurred to bring your account current.

Electronic Documents and Communication

  • With your permission, we may send documents related to your account electronically instead of in paper form. These documents include notices, disclosures, records, and other account-related information.
  • Providing consent does not guarantee that all documents will be electronic, but rather that they may be provided in that format when available.

Liability and Insurance

  • Scoop and Go Pros LLC carries all required local, state, or federal licenses and maintains at least $1 million in general liability insurance.
  • Scoop and Go Pros LLC is not liable for damage to yards, gates, pets, or other property.

Refund Policy

  • If a refund is provided, it will be minus any bank/credit card processing fees and prorated service charges, if applicable.
  • Account credits may be issued on a case-by-case basis and will be applied to your next invoice or remain on your account without expiration.

Weather & Service Interruptions

  • In cases of hazardous weather, services may be postponed until conditions improve. If a cleanup cannot be rescheduled, the Average Monthly Rate will still apply due to the increased waste and time required at the next visit.
  • If your pet(s) will not be using the yard for a period (e.g., vacation or illness), and you wish to pause service, notify us at least 24 hours in advance to adjust your billing.
  • If your pet(s) remain in the yard but you choose to skip a visit, the Average Monthly Rate will still apply.
  • Service is conducted from sunrise to sunset and occurs rain or shine unless conditions become unsafe.
  • Service may be performed on weekends (Saturdays and Sundays) if necessary.
  • We may need to reschedule service due to weather, road conditions, or other factors beyond our control.
  • Service days are determined based on your address to optimize efficiency and maintain competitive pricing.
  • Your monthly rate includes scheduled closures for major holidays: New Year's Day, Memorial Day, Independence Day (4th of July), Labor Day, Thanksgiving & the following Friday, and Christmas Week.
  • If service is paused due to extreme weather or other uncontrollable events, charges may still apply due to increased waste at the next visit.

Consent to Contact

By providing your phone number and/or email, you consent to receiving calls, texts, emails, or other electronic communications, including those made through automated dialing systems or prerecorded messages for billing, customer care, additional service options, or collections.

Liability & Policy Updates

  • Scoop and Go Pros LLC and its owners, employees, and affiliates are not responsible for any damage to yards, gates, pets, or other property.
  • Terms, fees, and promotions are subject to change, but we will provide at least two weeks' notice before any adjustments take effect.

Service Cancellation

You may cancel your service at any time for any reason without penalty or cancellation fees.

Service Delays and Force Majeure

  • Events beyond our control (e.g., severe weather, government orders, natural disasters) may delay or suspend services. These do not constitute service abandonment.
  • If service/visit is delayed more than 14 days, Scoop and Go Pros will not charge you and will communicate with you as soon as possible with updates as to when services can and will be resumed.

Enforceability

If any part of these Terms of Service is deemed unenforceable by law, the remaining provisions remain valid.

No Waiver of Rights

Acceptance of late or partial payments does not waive the Service Provider's (Scoop and Go Pros LLC) rights to enforce these Terms.

Entire Agreement

These Terms of Service constitute the entire agreement between you and the Service Provider, superseding all previous agreements. No verbal promises or agreements are part of this contract.

By using our services, both parties agree to these terms and responsibilities.
